Amounts awarded
If the tribunal finds agains the employer, there are different levels of awards depending upon the nature of the case.
Unfair dismissal
The amount is made up of two elements:
1) A basic award, which takes into account the age and service of the claimant. This is capped at £10,500.
2) A compensatory award based on the loss of past and future earnings and how unfair the dismissal was. Compensatory awards are generally capped at £66,200 but can be higher in certain cases, for example, whistleblowing or health and safety claims.
Breach of contract
Awards are capped at £25,000 by tribunals. However, a claimant can make claim in the courts which is uncapped. Typically, this might happen if a director claims substantial compensation under the terms of an employment contract.
Discrimination
Awards are uncapped. In addition to loss of earnings, claimants can claim for injury to feelings.
