Getting help and advice

A range of support is available, depending upon the complexity of the case.

Some companies chose to use legal representatives or tribunal firms with specialist knowledge and experience.  This can be necessary in complex cases as they at least ensure that all bases are covered.  But for a small and medium size business you need to weigh up the cost verses the benefits of such support.  For example they will often encourage an ‘out of court’ settlement if there is any doubt that the case can be won; this can be cheaper, but you may feel justice has not been served.

You can also use external arbitration services such as ACAS to try to resolve disputes.  As well as providing conciliation services, ACAS provides publications and training courses.

You may also need legal advice, from either a solicitor or a specialist consultant.

Finally, consider using management consultants such as ourselves who can set up workable procedures and train your managers to follow them, thus minimising the risk and cost of tribunal all together.
